Terms of Service
Please read these terms carefully before using Pool Canvas. By using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms
By accessing or using the Pool Canvas website (poolcanvas.io), web application, mobile application, embedded widgets, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Pool Canvas ("Company," "we," "us," or "our"). We reserve the right to update these Terms at any time. Continued use after changes are posted constitutes acceptance of the revised Terms.
2. Description of Service
Pool Canvas is an AI-powered pool visualization platform that allows homeowners to upload photographs of their backyard and receive AI-generated renderings of custom swimming pool designs. The Service may also be offered as an embedded tool on third-party pool builder websites.
3. Eligibility
You must be at least 18 years of age to use the Service. By using Pool Canvas, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
4. User Accounts
Certain features may require you to create an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You agree to provide accurate, current, and complete information during registration and to update it as necessary.
You must notify us immediately of any unauthorized use. We are not liable for losses arising from your failure to secure your account credentials.
5. User Content & Uploads
5.1 Ownership
You retain ownership of photographs, images, and other content you upload ("User Content"). By uploading, you grant Pool Canvas a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify, and process your User Content solely for the purpose of providing, improving, and marketing the Service.
5.2 Your Representations
You represent and warrant that you own or have the necessary rights to upload your User Content, and that it does not infringe on any third party's intellectual property, privacy, or other rights.
5.3 Prohibited Content
You agree not to upload content that is illegal, obscene, defamatory, threatening, or that violates any applicable law or third-party rights. We reserve the right to remove any content that violates these Terms without notice.
6. AI-Generated Output
6.1 Nature of Output
Pool designs generated by our AI ("Generated Content") are conceptual visualizations. They may not accurately reflect real-world conditions including property boundaries, grading, utilities, soil composition, setback requirements, zoning regulations, or structural feasibility.
6.2 License to Generated Content
Subject to these Terms, we grant you a non-exclusive, non-transferable license to use Generated Content for personal, non-commercial purposes such as sharing with contractors or family members. Pool builders who access the Service through a commercial plan may use Generated Content in connection with their business as permitted by their specific subscription agreement.
6.3 No Guarantees
We do not guarantee the accuracy, completeness, or feasibility of any Generated Content. AI outputs may contain errors, distortions, or unrealistic features. You acknowledge that all construction decisions should be made in consultation with licensed professionals.
7. Prohibited Uses
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation
- Reverse-engineer, decompile, or disassemble any aspect of the Service
- Attempt to gain unauthorized access to any part of the Service or its related systems
- Use automated tools, bots, or scrapers to access or extract data from the Service
- Interfere with or disrupt the integrity or performance of the Service
- Resell, redistribute, or sublicense the Service or Generated Content without authorization
- Upload photographs of properties you do not own or have permission to photograph for the purpose of visualization
- Use the Service to generate content that is misleading, fraudulent, or deceptive
- Circumvent any access controls, rate limits, or usage restrictions
8. Intellectual Property
The Service, including its software, algorithms, AI models, user interface, graphics, logos, trademarks, and all related intellectual property, is owned by Pool Canvas and protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service beyond the limited usage rights expressly stated herein.
The "Pool Canvas" name, logo, and all related marks are trademarks of Pool Canvas. You may not use them without our prior written consent.
9. Third-Party Services
The Service may integrate with or contain links to third-party websites, services, or tools (including pool builder websites on which Pool Canvas is embedded). We are not responsible for the content, policies, or practices of any third party. Your interactions with third-party services are governed by their own terms and policies.
10. Fees & Payment
Certain features of the Service may be offered on a free or paid basis. If you purchase a paid plan or subscription, you agree to pay all applicable fees as described at the time of purchase. Fees are non-refundable except as required by law or as expressly stated in a separate agreement.
We reserve the right to change pricing at any time. If you are on a recurring subscription, we will provide at least 30 days' notice before any price increase takes effect for your account.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or harmful components. We do not warrant the accuracy or reliability of any AI-generated content.
Pool Canvas is not a licensed contractor, architect, or engineer. The Service does not provide professional construction, engineering, or architectural advice. Any reliance on Generated Content for construction decisions is at your own risk.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, POOL CANVAS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.
Our total aggregate liability for all claims arising from these Terms or your use of the Service shall not exceed the greater of (a) the amount you paid to Pool Canvas in the twelve (12) months preceding the claim, or (b) one hundred dollars ($100).
13. Indemnification
You agree to indemnify, defend, and hold harmless Pool Canvas and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, your violation of these Terms, or your violation of any third-party rights.
14. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may stop using the Service at any time. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including Disclaimers, Limitation of Liability, Indemnification, and Governing Law) shall survive.
15. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict-of-law principles. Any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Prince George's County, Maryland.
Before filing any formal claim, you agree to attempt to resolve the dispute informally by contacting us at the address below. If the dispute is not resolved within thirty (30) days, either party may proceed with formal dispute resolution.
16. Changes to These Terms
We may revise these Terms at any time by posting the updated version on our website with a new effective date. Material changes will be communicated via email or a prominent notice on the Service. Your continued use after changes take effect constitutes acceptance.
